Court seeks report on KP CM Oath delay

Peshawar High Court asks for details on the Governor’s availability amid a petition challenging the delay in the new KP Chief Minister’s oath.

PESHAWAR; (UrduPoint/UrduPoint / Pakistan Point News-Oct,14, 2025) The Peshawar High Court has directed authorities to inform the court about the availability of Khyber Pakhtunkhwa’s Governor regarding the oath-taking ceremony of the province’s newly elected Chief Minister.

According to the court’s written order issued on a petition filed by the Speaker and members of the provincial assembly under Article 255 of the Constitution, the Additional Advocate General has been instructed to update the court by 1 p.m. today about the Governor’s availability to clarify reasons behind the delay in the swearing-in process.

The petitioners argued that the delay in administering the oath to the newly elected Chief Minister is hindering the constitutional process and must be resolved immediately. The court has directed all concerned parties to submit a complete report on the Governor’s availability and constitutional requirements.

Meanwhile, Jamiat Ulema-e-Islam (JUI-F) has challenged the election of the new Chief Minister, Sohail Afridi, in the Peshawar High Court. The petition, filed by JUI-F’s parliamentary leader in the provincial assembly, Lutf-ur-Rehman, through Barrister Yasin Raza, argues that the previous Chief Minister’s resignation has not yet been accepted, making the election of a new Chief Minister unconstitutional.

The petition further noted that the Governor has summoned former Chief Minister Ali Amin Gandapur on October 15 to confirm his resignation.

Speaking to the media earlier, Lutf-ur-Rehman said the election was conducted illegally and that the previous Chief Minister remains in office until his resignation is formally accepted. He questioned the urgency behind the move, stating that the previous Chief Minister can continue working until the legal process is completed.
