Supreme Court (SC) has ordered to pay salaries to the employees of private school at Khyber Pakhtunkhwa (KP) according to pay scales
Islamabad (Pakistan Point News / Online - 10th June, 2019) Supreme Court (SC) has ordered to pay salaries to the employees of private school at Khyber Pakhtunkhwa (KP) according to pay scales.Court has ordered Board of governors of private school to fix the salaries of employees as per pay scale.The court has said in its decision that board of governors should fix and pay the salaries of the employees according to pay scales.High court had ordered the private school to pay the salaries as per pay scale.
The school management had challenged the decision in SC.A 3-member bench of SC presided over by Justice Gulzar Ahmad took up the case for hearing Monday.During the course of hearing of the case Justice Gulzar Ahmad inquired " is it private or government school.Advocate General KP told the court " this is a private school. The salaries of the employees are paid and other expenses are incurred out of students fee.Justice Gulzar Ahmad remarked " School will be either private or government and it cannot be anythird kind of thing.
The counsel for school employees said that this school was regularized in 2014. The employees are being paid fixed salaries since 2012. Regularization remained of no avail.Justice Maqbool Baqir remarked � you are not government employee. Your salaries are paid out of fees of students.The counsel for the employees said " we don't want to be paid salaries at par with government employees. We want salaries should be paid according to pay scales after regularization.
Justice Maqbool Baqir remarked " Regularization is a separate thing and salaries matter is a separate matter.Additional advocate general KP told the court that employees are being paid salaries as per contract.Justice Maqbool Baqir inquired from additional advocate general " you should tell if the salaries were determined according to pay scale.Additional advocate general KP told the court the powers for determining the salaries rest with board of governors.
The bench while expressing annoyance with additional advocate general and counsel for employees remarked " your attitude is non serious. You are wasting our time on such a small matter. You have not come here with preparations. You are saying " do this and do that You don't know even a single word about this case.The court while ordering board of governors of private school to fix the salaries as per pay scale disposed of the matter.
