Russia Works to Create National Sports Arbitration Body - Deputy Justice Minister

Russia is creating a special sports arbitration institution designed to resolve disputes between athletes, coaches, their agents, sports federations and clubs, Deputy Justice Minister Denis Novak told reporters on Thursday

MOSCOW (Pakistan Point News / Sputnik - 04th April, 2019) Russia is creating a special sports arbitration institution designed to resolve disputes between athletes, coaches, their agents, sports federations and clubs, Deputy Justice Minister Denis Novak told reporters on Thursday.

According to Novak, the Council for the Improvement of the Arbitration Proceedings recommended that the Justice Ministry assigns the status of a permanent arbitration institution to the ANO (Autonomous Nonprofit Organization) Sports Arbitration Chamber.

"Forty-five members of the council supported the decision, one was against. The decision to issue a recommendation was made," Novak said.

According to the deputy minister, the arbitration body will consider a limited range of disputes, in particular disputes regarding sports clubs and federations, including individual labor disputes of athletes and coaches, as well as doping disputes.

"The legislator has stipulated that a special institute should be created for this. But, of course, we need to make necessary adjustments in the area of relations with labor laws, because for now we have a problem that, according to the labor and civil procedure code, labor disputes fall within the competence of public general courts," Novak said.

The task is to ensure that such disputes are not referred to foreign courts, but are resolved in Russia, he added.

As of now, sports disputes are resolved either in the Russian courts of general jurisdiction or in the Swiss-based International Court of Arbitration for Sports (CAS).
