Poland to Challenge Top EU Court Order to Reverse Judge Retirement - Senior Politician

Poland will appeal an order by EU's top court to suspend retirement of the country's Supreme Court judges over 65, the leader of the ruling Law and Justice (PiS) party said Friday.

Court of Justice Vice President Rosario Silva de Lapuerta ruled earlier in the day that Poland should stop forcing judges into retirement and bring back those already out of job.

"We have a right to appeal. This is a provisional, unilateral decision and we will challenge it," Jaroslaw Kaczynski said, adding that Poland had the right to defend its interests within EU laws.

The interim order was passed after the European Commission sued Warsaw for what it sees as a violation of EU laws on judicial independence.

The Polish law, one of a batch of motions aiming to overhaul the country's judiciary, lowered the retirement age for Supreme Court judges to 65 from 70, allowing only those who received the president's approval to keep their jobs.
