ISLAMABAD (Pakistan Point News / Online - 06th May, 2019) , Supreme Court Chief Justice Asif Saeed Khosa on Monday remarked private schools earned millions of rupees annually on the pretext of 5 per cent increase in fees, adding that, the recent audit report is an eye opener in this regard.The Chief Justice remarked during hearing of the case pretending annual increase in private schools fees.Justice Khosa remarked definition is available in the relevant law which defines between a profit-making entity and profession, adding that, this profession has been regularized through a proper mechanism.

He further remarked qualification is a must for this profession or business.He remarked there are around 17,000 private schools in the system and off them there is hardly a one which didn't increase its annual fee less than 5 per cent. A three-member bench, headed by Chief Justice Asif Saeed Khosa conducted hearing of the case.He further asked is there any strategy under which these private schools are running so that they can solve the matter.

The Article-18 doesn't explain individual case but talk about both industry and institutions, Justice Khosa further remarked. He further elaborated that the articles 10 to 17 and 19 and 20 talk about rights of citizens. Its state right to regularize the industry, he added.The Article-25A talks about state obligation to provide free education to children, and cooperation of private schools will be included in it. The article has been kept opened and if private schools comply with their legal obligations they can be regularized under the Article 18.

Justice Ijaz Ul Ahsan remarked private schools charge security fee at the time of admission, adding that they kept that money with them for years, observing return of that fee should be.Lawyer's private schools Makhdoom Ali Khan argued that different provinces have different rules and regulations. He said no increase has been made on fee less than Rs4,000, adding that 5 per cent increase has been made with the approval of the government.
