Court Directs To Register FIR Against HESCO Officials

HYDERABAD (UrduPoint / Pakistan Point News - 03rd Nov, 2016 ) : The District and Session Judge Hyderabad has ordered the police here Thursday to register an FIR against officials of Hyderabad Electric Supply Company in a case of electrocution to death.
According to the details, the applicant Muhammad Iqbal Solangi pleaded in the court that the police were not registering FIR against the company's officials in an accident in which his family member Ghulam Mustafa Solangi was electrocuted on Oct 18.
He cited HESCO's Chief Executive, Superintending Engineer, Executive Engineer Nabi Shah and 3 other officers as the respondents. During the hearing the HESCO's counsel argued that the incident was an act of God and that the company's officials could not face the criminal litigation.
"This application is not maintainable and [HESCO's counsel] termed the incident as an act of God .
.. ," the judge's order quotes the lawyer as stating. "The bereaved family of the deceased can claim damages under the Fatal Accident Act but the officials of HESCO cannot be dragged into the criminal litigation," the counsel advocate Babur Ali Kazmi further contended.� However, the court did not agree with the lawyer's contention and said� the incident was caused by sheer human negligence and that it could not be acknowledged as an act of God.
The court ordered the police to register FIR on the complaint of the applicant Muhammad Iqbal on the basis of his verbatim statement. According to Iqbal, Ghulam Mustafa was electrocuted on Oct 18 outside a school in Latifabad Unit 6 where he had gone to drop his 2 children.
