Constitutional petition filed challenging CJP Khosa’s oath-taking

The petition states that constitutional obligations were not fulfilled during the oath-taking of Justice Khosa.

Lahore (Pakistan Point News – 2nd February, 2019) A constitutional petition has been filed in the Peshawar High Court (PHC) asking Chief Justice of Pakistan (CJP) Justice Asif Saeed Khosa to take oath again.

The petition has been filed by journalist Shahid Orakzai.

The petitioner adopted that President Dr Arif Alvi administered oath to the CJP on January 17, 2019 while the president went to Karachi on October 27, 2018 on government expense.

It states that President Alvi’s taking oath from the country’s top adjudicator is against the relevant constitutional obligations for he belongs to a political party.

The petition demands that the CJP should take the oath of the office again as the constitutional obligations were not fulfilled during the oath-taking of Justice Khosa.

The president has been made a party in the petition.

Justice Asif Saeed Khan Khosa took oath of office as 26th Chief Justice of Pakistan on January 18 after his predecessor Justice Saqib Nisar completed his stint on January 17.

President Dr Arif Alvi administered oath of office to the new chief justice in a ceremony held at Aiwan-e-Sadr.

The swearing in ceremony was attended by Prime Minister Imran Khan, judges of the Supreme Court, members of the Federal cabinet, Speaker National Assembly, Chairman Senate, three services chiefs, governors, lawyers and other dignitaries.

During his legal career, Justice Asif Saeed Khosa decided about 55,000 cases over a period of more than nineteen and a half years so far.
