Trump Administration Asks US Supreme Court To Review Legality Of Ending DACA

WASHINGTON (Pakistan Point News / Sputnik - 06th November, 2018) The Department of Justice on Monday filed legal requests with the US Supreme Court to resolve the legality of ending the Deferred Action for Childhood Arrival (DACA).

DACA allowed undocumented immigrants, who were brought to the United States illegally as children and are known as "Dreamers," to stay and work in the United States.� The Trump administration rescinded DACA but a US court ruled in August that the rescission was unlawful and DACA must be fully reinstated.

"The questions presented are as follows: 1. Whether the decision to wind down the DACA policy is judicially reviewable ... and lawful," the legal request filed by Justice Department's Solicitor General Noel Francisco stated.

The Justice Department said Monday's requests were filed with cases in the US states of California and New York as well as in the District of Columbia.

The intent is for the US Supreme Court "to consider the dispute during the current term," before any appeals courts have made the move challenging the issue, the Justice Department said.

Previously, the US Supreme Court told the Trump administration that it wanted to hear from an appeals court before it could consider the legality of such action.

The Trump administration has attempted to end DACA numerous times, each time facing restraint from the US Supreme Court on the basis of lack of due process.
