The German Federal Administrative Court decided on Wednesday that Tunisias Sami A., who is believed by the German authorities to be a former bodyguard of terrorist Osama bin Laden, must be returned to Germany after his deportation to Tunisia.

Last month, Sami A. was deported to Tunisia where he was later released over the lack of charges. The suspect will not be allowed to leave the country until the end of the investigation. According to an earlier verdict of a court in the German city of Gelsenkirchen, the authorities responsible for deportation of Sami A. must return him to Germany and cover the costs. Authorities of the city of Bochum appealed the verdict but the Federal Administrative Court upheld the ruling.

"Today the Federal Administrative Court upheld this decision and dismissed the appeal of the city of Bochum," the court said in a press release.

The Wednesday verdict cannot be appealed in any other court.

Sami A. had been living in the city of Bochum with his German wife and children since 1997, and the German authorities had been seeking to extradite him to Tunisia from as far back as 2006. Last year, a German court ruled that extradition was impossible because Sami. A would likely face torture in his homeland.

In April, media reports revealed that Sami. A was receiving over $1,000 per month in social benefits, despite the authorities having designated him as a security threat.

In June, the former bodyguard was detained by the authorities for deportation under a new court ruling. German media have suggested that this happened because the most recent court order to halt the deportation had failed to reach the authorities in time.
