‘Speedy justice must for making better Pakistan’

Speedy justice is a must for making Pakistan a better society and the huge backlog of pending cases in courts is a matter of grave concern, said Pasban e Pakistan President Altaf Shakoor here Friday.

KARACHI,(Pakistan Point News - 02nd Feb, 2018) : Speedy justice is a must for making Pakistan a better society and the huge backlog of pending cases in courts is a matter of grave concern, said Pasban e Pakistan President Altaf Shakoor here Friday. He said that as per the statistics of Law and Justice Commission of Pakistan as many as 1873085 cases were pending in apex and subordinate courts as of November 30, 2017. He said the apex judiciary has already been taking steps to streamline the justice system in the country.

He said many decisions have already been taken in this regard, which are highly appreciated, however, still there is an uphill task, and huge backlog of pending cases could be dealt with befitting strategies. He said the existing laws about arbitration should be fully implemented, so as to reduce workload from the already overburdened courts. Altaf Shakoor said that when the Germans were bombing London, UK Prime Minister Winston Churchill was briefed on the casualties and economic collapse.

He asked, “Are the courts functioning?” When told that the judges were dispensing justice as normal, Churchill replied, “Thank God. If the courts are working, nothing can go wrong.” He said our society also needs this type of a speedy justice. He said speedy justice refers to the speediness along with prudence and wisdom observed in the final disposition of cases. Small claims courts have the sole objective of dispensing speedy justice between the parties.

Further, dispensing speedy justice between the parties according to the rules of substantive law had been the general purpose of almost all statutes. For example, under the rules of the juvenile court, the court could dismiss a case either with or without prejudice if it found that the time limits of juvenile speedy justice were violated. He said many weaknesses in our justice system are the root cause of our failing society, and only by strengthening our justice system we can strengthen our society.

He asked why the politicians, especially the ruling parties, are silent on this important issue. He said that many political parties do not have inner democracy and they practically do not believe in any law and rule, saving the norms of family-run politics. He said with a practical uphold of rule and law in every sector including politics we can build a better, progressive and prosperous Pakistan.
