LHC issues notices on plea against Nawaz's disqualification

LAHORE, (UrduPoint / Pakistan Point News - 14th Dec, 2017 ) :The Lahore High Court (LHC) on Thursday issued notice to the federation, Election Commission of Pakistan (ECP) and others on a petition, challenging an ECP notification denotifying ex-prime minister Muhammad Nawaz Sharif as the Member National Assembly (MNA).

Justice Shahid Karim heard the petition, filed by Lawyers' Foundation for Justice. During the hearing, the petitioner's counsel AK Dogar, arguing before the court, submitted that on July 28, the ECP denotified Nawaz Sharif, which was illegal and unlawful as the prime minister could only be removed through the parliament.

He pointed out that a no-confidence motion was the only way under Article 95 A of the Constitution for removal of the prime minister. Nawaz Sharif was elected through vote and thus his de-notification was unconstitutional, he added.

He asked the court to set aside the notification de-notifying Nawaz Sharif and suspend it till decision on the petition. The court, after hearing initial arguments, issued notices to the respondents and sought a reply.
